1. Who we are

This policy explains how Reimers Kapital handles personal data collected through our website, https://reimerskapital.ch.

For the purposes of the Swiss Federal Act on Data Protection (FADP) and, where it applies, the EU General Data Protection Regulation (GDPR), the controller is:

Reimers Kapital AG Gubelstrasse 15 6300 Zug Switzerland

2. What this policy covers

This policy covers the website only — what happens when you browse it, and what happens if you send us an enquiry through it.

Once we begin discussing a mandate with you, or you become a client, additional processing applies (for example client due diligence and anti-money-laundering checks, and record-keeping obligations under Swiss law). That processing is described separately in our client engagement documentation and is not covered here.

Our website does not:

  • allow visitors to register accounts or log in
  • accept public comments
  • run advertising or advertising trackers
  • profile visitors, or make any automated decision that affects you
  • knowingly collect data from children

3. The personal data we collect

3.1 Information you give us — the enquiry form

Our contact page has one form. When you submit it we receive:

Field Required
Name Yes
Company No
Telephone Yes
Email address Yes
Capital requirement No
Message No
Consent confirmation Yes

Anything you choose to write in the message field is also personal data. Please do not include confidential transaction details, or personal data about other people, in a first enquiry — an unencrypted web form is not the right place for it. Tell us what you need in outline and we will agree a secure channel.

Enquiries are delivered to us by email. They are not stored in the website’s database and the website does not build any record of past enquiries.

3.2 Information collected automatically

Our hosting provider records standard server access logs when any page is requested. These typically contain your IP address, the date and time of the request, the page requested, your browser’s user-agent string and the referring page. They are generated for security and operational reasons and are not used to identify individual visitors.

3.3 Spam filtering

Enquiries are checked by Akismet, an anti-spam service. To do this, the content of your submission together with your IP address and browser user-agent is transmitted to Akismet’s operator, Automattic Inc., and assessed against its spam database. If we did not do this, the form would be unusable within days.

4. Why we use it, and on what legal basis

What we do Why Legal basis (GDPR, where it applies)
Read and reply to your enquiry To answer your question and discuss whether we can help Steps taken at your request before entering a contract (Art. 6(1)(b)); your consent (Art. 6(1)(a))
Keep a copy of the correspondence So we have a record of what was discussed Our legitimate interest in keeping business records (Art. 6(1)(f))
Spam filtering To keep the form usable and our systems secure Our legitimate interest in security (Art. 6(1)(f))
Server logs Security, fault diagnosis, keeping the site available Our legitimate interest in operating the site securely (Art. 6(1)(f))
Loading fonts and the office map To display the site as designed Our legitimate interest in presenting a functioning website (Art. 6(1)(f))

Under Swiss law we do not generally need a legal basis of this kind, but we must process data lawfully, in good faith and proportionately, and we must be transparent about it. This section is written to satisfy both regimes.

Where we rely on your consent, you can withdraw it at any time by emailing us. Withdrawing consent does not affect anything done before you withdrew it.

5. Who your data is shared with

We do not sell personal data, and we do not share it for anyone else’s marketing.

Your data is handled by the following service providers, each acting on our behalf or as a separate controller for its own limited purpose:

Provider What it does Where
GoDaddy [confirm contracting entity] Website hosting; server logs Europe
Automattic Inc. (Akismet) Spam filtering of form submissions United States
Google (Google Fonts, Google Maps) Serves the site’s typefaces; displays the map of our office United States / global
Google Receives and stores enquiry emails Europe

We may also disclose personal data where we are legally required to — for example to a court, a regulator or a tax authority — or where it is necessary to establish or defend a legal claim.

Google Fonts and Google Maps

Two elements of the site load directly from Google’s servers: the typefaces used throughout, and the map on the contact page. When your browser requests them, your IP address is transmitted to Google, which may process it in the United States. This happens as the page loads, before you interact with anything.

If you would rather this did not happen, you can block third-party requests in your browser, though the site’s appearance will change.

6. Transfers outside Switzerland and the EEA

Some of the providers above are in the United States. Switzerland and the EU both permit transfers to the US on the basis of the respective data privacy frameworks, and where a provider is not covered by one, transfers are made under the European Commission’s Standard Contractual Clauses (recognised for Swiss purposes by the FDPIC) together with the safeguards those clauses require.

You can ask us for details of the specific mechanism relied on for any provider listed above.

7. How long we keep it

Data Retention
Enquiries that do not lead to a discussion 12 months, then deleted
Enquiries that lead to a mandate or engagement Kept with the client file, for as long as the relationship lasts and afterwards for the periods required by Swiss commercial and anti-money-laundering law (generally 10 years)
Server logs As set by our hosting provider
Spam-classified submissions Held by Akismet in line with its own retention policy

8. Your rights

Under the Swiss FADP and, where it applies, the GDPR, you may ask us to:

  • confirm whether we hold personal data about you, and give you a copy of it
  • correct anything inaccurate
  • delete it, where we have no continuing reason or legal obligation to keep it
  • restrict how we use it, or object to processing we base on legitimate interests
  • provide it in a portable format, or transfer it, where that right applies
  • withdraw consent you have given

To exercise any of these, email haydn@reimerskapital.ch. We will respond within 30 days. We may need to verify your identity first — that is to protect you, not to obstruct you.

If you are not satisfied with how we have handled your data, you can complain to:

  • Switzerland — the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern · edoeb.admin.ch
  • EU/EEA — the supervisory authority in your country of residence or workplace

We would rather hear from you first, and would appreciate the chance to put things right.

9. Cookies and similar technologies

Our website does not use cookies for advertising or cross-site tracking.

Cookie Purpose Set when Life
wp-settings-*, wp-settings-time-* Remembers screen preferences in the WordPress admin Only for logged-in site administrators 1 year
Session cookies set by our hosting platform Load balancing and platform operation On page load Session

Third-party requests to Google (fonts, map) may result in Google setting or reading cookies in your browser under its own policies. See section 5.

You can delete or block cookies through your browser settings. Blocking them will not prevent you using the site or the enquiry form.

[TO CONFIRM BEFORE PUBLISHING — see the note accompanying this draft: additional analytics cookies from the hosting platform were observed during testing and must either be disabled or disclosed here.]

10. Security

The site is served over HTTPS, so what you send through the form is encrypted in transit. Access to the website’s administration and to enquiry emails is limited to people who need it.

No method of transmission over the internet is completely secure. This is why we ask you not to send confidential transaction information or sensitive personal data through the enquiry form, and to wait until we have agreed a secure channel.

11. Changes to this policy

If we change how the site handles personal data, we will update this page and change the date at the top. Where a change is significant we will say so clearly rather than leaving you to spot it.
